Privacy and Fair Processing Policy
At the Employer Covenant Working Group Limited (‘ECWG Ltd’) we are committed to protecting your privacy and to fairly processing personal data in a transparent way. This statement is made in the light of the requirements of the Data Protection Act 1998 and the General Data Protection regulations (GDPR) in order to alert data subjects to the ECWG Ltd data processing practices which will govern the processing of your data. How do we collect information?
We do not usually obtain information from members of the public as we are primarily a trade body. We may obtain personal information from you when you enquire about our activities, register with us or otherwise provide us with personal information.
Legal basis for processing data
We rely on the ‘legitimate interests’ lawful basis for processing data on the basis that individuals would have a reasonable expectation that we will process the personal data they have provided. On this basis, whilst individuals have the right to ‘opt out’ of their data being processed in certain instances, in the main there is not a need to require them to ‘opt in’. Therefore, we continue to lawfully process personal data from existing databases without re-permissioning.
In some instances, we may rely on your express consent to use your personal information, but we will let you know (and give you the chance to withdraw consent) if we do. An exception is where you send us information, either directly or through a third party, and ask us to take further action. In this case we will use the information for the purpose requested without further reference to you. In some instances we may use your personal information in order to enable us to perform a contract which we have in place with you.

What information do we collect?
We may hold your personal information because you supplied it to us, or because we learned it from someone else, either in the context of providing our services to you or in the context of our Association business more generally, or because it is publicly available. The personal information will generally consist of your name, contact information and your job title (for Members and business contacts), but may from time to time include further information, such as information about your attendance at ECWG Litd meetings.

We would use your personal information to provide you with the services or information you have requested, for administration purposes and to further our aims and objectives.

How do we protect personal information?
We take appropriate measures to ensure that the information disclosed to us is kept secure, accurate and up to date and kept only for so long as is necessary for the purposes for which it is used. Data is held at secure locations and computer data is securely stored, with back-up protection, against data loss, viruses, spyware, worms and trojans. For additional protection, data may also be stored on the cloud.
We will retain your personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements and for as long as we have a business reason for doing so.
If there is a data breach, this must be reported to the individual with data controller responsibilities at the organisation within 24 hours of such a breach being identified by contacting us at firstname.lastname@example.org
Those affected by a breach should normally be advised or alerted within 72 hours of that breach.
Serious data breaches likely to result in a risk to the rights and freedoms of individuals will be notified to the ICO, the UK supervisory authority for data protection issues, at www.ico.org.uk
Will we disclose the information we collect to outside parties?
We will not normally share information with service providers, associated organisations and agents. We may need to disclose your information if required to do so by law.
However, we share your information with third-party service providers where they reasonably require it to perform their obligations or in order to enable us to achieve the objective of our processing. The service providers include:
Information about members of the ECWG Limited, for example, names, employers, email and telephone numbers will be held by the organisation and will be shared with other members and may feature on the website of the organisation for example in lists of members, contact details or lists of office holders. Such information may also be shared with members of the public at their request from time to time if this could be reasonably expected by the data subject.
Transferring information outside the EU
Where needed in order to enable us to achieve the objective of our processing the data as described above, we may transfer your personal information to third parties outside the EEA. ECWG Ltd reserves the right to vary event registration fees and the prices of any goods or services listed without notice. All event registrations and orders for goods or services are subject to availability and ECWG Ltd reserves the right to refuse to accept any registration and to refuse to supply any goods or services to any individual.
Although the Website may use encryption security software in areas where on line payment details are accepted, the security of information and payments transmitted via the Internet cannot be guaranteed. ECWG Ltd shall not be held to be in breach of its obligations hereunder nor liable to the User for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control including without limitation any act of God, fire, storm, flood, lightening, disease, strike, trade dispute, act of terrorism, any act or omission of government or regulatory bodies or communications operators.

The terms and conditions and the use by the User of the Website shall be governed by the laws of England and Wales and the parties hereto submit to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the Website and/or any transactions made on the Website, or these terms and conditions.
